Article 1403(2) HCC requires that the contract be entered in a special public register in order for it to be binding on third parties as well.

The authentic instrument in which the spouses opted for the community of property regime is entered in the register along with all relevant aspects, such as names, the extent of the community of property regime and details about its termination.

4.3. How and by whom can the information in the register be accessed?

Any person with a legitimate interest can access the public register containing the aforementioned registrations.

4.4. What are the legal effects of registration (validity, opposability)?

The contract takes effect and is opposable to third parties when it is entered in the special public register (Art. 1403 HCC).
